These Terms of Use (the "Terms") are a legal agreement between you and CouchVote ("we", "us", "our") and govern your use of the CouchVote mobile app (iOS and Android) and the website at couchvote.com (together, the "Service"). This document also serves as the End User License Agreement (EULA) for the CouchVote app.

By downloading, installing, or using CouchVote, you agree to these Terms. If you do not agree, please do not use the Service.

TL;DR

  • CouchVote helps your group decide what to watch. The core experience — timed voting, vetoes, and full movie nights — is free.
  • CouchVote Pro is an optional auto-renewable subscription that adds online voting and extra features.
  • Subscriptions renew automatically until cancelled. You can cancel anytime in your App Store or Google Play account settings.
  • Be respectful, don't misuse the Service, and remember movie data comes from third parties (TMDB, OMDB).

1. Who We Are

CouchVote provides a couch consensus engine that helps people decide what to watch together. You can reach us at legal@couchvote.com.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use CouchVote. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian.

3. Your Account

CouchVote is passwordless. You sign in with a one-time email code, Apple Sign-In, or Google Sign-In. You are responsible for keeping access to your sign-in method secure and for activity that happens under your account. Let us know promptly if you believe your account has been compromised.

4. The Service

CouchVote lets you and your couch create voting sessions, swipe and vote on titles, apply rules and vetoes, and reach a group decision. Movie and show metadata (titles, posters, overviews, ratings, and streaming availability) is provided by third parties and may not always be complete, current, or accurate. CouchVote does not host, stream, or sell any movies or shows, and is not affiliated with, endorsed by, or sponsored by any streaming platform or studio.

5. CouchVote Pro Subscriptions

CouchVote offers an optional auto-renewable subscription, CouchVote Pro, that unlocks additional features such as online voting across devices, premium recommendations, advanced rules, recurring reminders, and higher limits. The free tier remains fully usable without a subscription.

5.1 Billing and Auto-Renewal

  • Payment is charged to your Apple App Store or Google Play account at confirmation of purchase.
  • Subscriptions renew automatically for the same period and price unless auto-renewal is turned off at least 24 hours before the end of the current period.
  • Your account is charged for renewal within 24 hours prior to the end of the current period.
  • The price and billing period (for example, monthly or annual) are shown in the app before you purchase and at checkout.

5.2 Free Trials

If a free trial is offered, any unused portion of a trial is forfeited when you purchase a subscription. If you do not cancel before the trial ends, the subscription converts to a paid term and your account is charged.

5.3 Managing and Cancelling

You can manage or cancel your subscription, and turn off auto-renewal, at any time in your platform account settings:

  • iOS: Settings → your name → Subscriptions.
  • Android: Google Play → Profile → Payments & subscriptions → Subscriptions.

Cancelling stops future renewals. Access to Pro features continues until the end of the current paid period.

5.4 Refunds

Purchases are processed by Apple or Google, and refunds are handled under their respective policies. We generally cannot grant refunds directly; please use your App Store or Google Play account to request one.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Attempt to access, tamper with, or disrupt the Service, its servers, or other users' accounts.
  • Reverse engineer, decompile, or attempt to extract source code of the app, except to the extent this restriction is prohibited by law.
  • Resell, sublicense, or commercially exploit the Service without our written permission.

7. License

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the CouchVote app on devices you own or control, for your personal, non-commercial use. We retain all rights, title, and interest in and to the Service, including all intellectual property. These Terms do not grant you any rights to our trademarks or branding.

8. Third-Party Content and Services

CouchVote uses the TMDB and OMDB APIs for movie metadata. This product uses the TMDB API but is not endorsed or certified by TMDB. Streaming availability is provided for convenience and may change. Your use of any third-party platform is governed by that platform's own terms.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that movie data will be accurate.

10. Limitation of Liability

To the maximum extent permitted by law, CouchVote will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Termination

You may stop using the Service at any time and delete your account from within the app. We may suspend or terminate your access if you violate these Terms or misuse the Service. Provisions that by their nature should survive termination (such as license restrictions, disclaimers, and limitation of liability) will survive.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date above and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws applicable where CouchVote operates, without regard to conflict-of-laws rules. Mandatory consumer protections in your country of residence still apply.
